Privacy Notice

This Privacy Notice explains how APEX Adult Studios LLC (“APEX”) collects, uses, discloses, and retains personal information through apex.vybetech.dev. The Service is intended only for adults in the United States. It is not directed to minors.

Information we collect

  • Account data: name, email address, Clerk user identifier, authentication events, and account settings.
  • Approval data: adult-status review result, review date, reviewer, method, limited internal reference, and review notes. Do not email identity documents unless APEX specifically provides a secure process.
  • Service activity: sign-in activity, requested pages, content viewed, timestamps, approximate location derived from IP address, and security events.
  • Device and network data: IP address, browser and device information, cookie or session identifiers, and diagnostic logs.
  • Communications: messages, legal requests, privacy requests, safety reports, and supporting information you choose to provide.

APEX does not currently collect payment-card information because the Service has no payment feature. Members cannot upload or publish content.

How we use information

We use information to create and authenticate accounts; conduct manual adult-access review; approve, deny, or revoke access; deliver private media; protect performers and members; prevent fraud and abuse; respond to requests; maintain records; comply with legal obligations; enforce our Terms; and operate, troubleshoot, and improve the Service.

Cookies and similar technology

The Service uses cookies and comparable technologies needed for sign-in, session continuity, fraud prevention, load balancing, and security. APEX does not currently use third-party advertising cookies, cross-context behavioral advertising, or targeted advertising. Where applicable, we treat a recognized Global Privacy Control signal as an opt-out request for sale or sharing; our current practice is not to sell or share data for those purposes.

Video-viewing privacy

APEX treats information that identifies a person as having requested or obtained specific video material as sensitive viewing information. We do not knowingly disclose identifiable viewing history except with the viewer’s legally valid consent, in the ordinary course of providing the requested service, or as otherwise permitted by law. We do not place advertising pixels on member viewing pages.

When information is disclosed

We disclose information only as reasonably necessary to service providers acting for APEX; to protect the rights, safety, and security of performers, members, APEX, or others; in a business transaction subject to appropriate safeguards; or when required or permitted by law. Our initial providers include Clerk (authentication), Fly.io (application hosting), Neon (database), and Cloudflare (DNS, security, and private media storage). Each provider may process technical information under its own contractual and legal obligations.

No sale or targeted advertising

APEX does not sell personal information, share it for cross-context behavioral advertising, or process it for targeted advertising. APEX does not use personal information to make decisions producing legal or similarly significant effects through automated profiling.

Retention

We keep account and approval records while an account is active and for a reasonable period afterward for security, disputes, and legal obligations. Security logs are retained only as long as reasonably necessary for those purposes. Personally identifiable video-viewing information is destroyed as soon as practicable and no later than one year after it is no longer necessary for the purpose collected, absent a pending lawful request or preservation duty. Performer records governed by 18 U.S.C. §§ 2257–2257A are maintained separately under their own statutory retention rules and are not member account data.

Security

APEX uses access controls, private object storage, short-lived media URLs, encrypted transport, limited administrative access, and service-provider safeguards. No system is perfectly secure. Please notify us immediately if you believe an account or personal information has been compromised.

Your privacy rights

Depending on where you live and whether a law applies to APEX, you may request access, confirmation, correction, deletion, portability, or a list of categories of third parties to which information was disclosed; opt out of sale, sharing, targeted advertising, or qualifying profiling; limit certain uses of sensitive information; withdraw consent; and appeal a denied request. APEX will not discriminate against you for exercising a privacy right. We may verify your identity and may deny or limit a request when an exception applies.

Submit a request to moneymase0926@gmail.comwith “APEX Privacy Request” in the subject. State your name, account email, state of residence, and request. An authorized agent must provide proof of authority. You may appeal a denial by replying with “Privacy Appeal.”

Minors

The Service is not intended for anyone under 18. We do not knowingly collect personal information from a minor. If we learn that a minor has provided information, we will disable access and delete the information when legally permitted. Report suspected minor access through our safety process.
